Restraining Orders

The law provides protections for people who have been harassed or threatened, including a restraining order prohibiting certain behavior. However, all the requirements for these rules have to be met for the restraining order to issue. Bruce has represented parties on both sides of restraining order appeals.

Bruce represented the respondent in an appeal from a civil harassment restraining order issued under Code of Civil Procedure § 527.6. The trial court found that the appellant engaged in a years-long course of harassment. On appeal, the Court of Appeal affirmed, holding substantial evidence supported the trial court’s findings and rejecting the appellant’s procedural and evidentiary challenges.

Bruce represented the appellant on appeal who had protests on the public sidewalk in front of a school. Bruce obtained a reversal of the restraining order on the ground that the speech was protected by the First Amendment. Details here. Bruce also obtained his attorney's fees from the school district.
