Attorney's Fees Issues

In general, parties bear their own attorney's fees. However, if either a contract or a statute permits the prevailing party to obtain attorney's fees from the other party, the trial court can award such fees. Appellate attorney's fees are also then available.

Bruce represented the respondent on appeal in a fee dispute between an attorney and his former client. Details here. The parties' contract provided that the prevailing party would be entitled to attorney's fees. The Court of Appeal deemed Bruce's client the prevailing party in the litigation and ordered the opposing party to pay Bruce's reasonable appellate attorney's fees (as determined by the trial court on remand).
